1. Scope

These General Terms and Conditions (GTC) apply to all orders and contracts between Tammaar GmbH (hereinafter "Tammaar") and its customers placed through Tammaar's online shops, websites, and other electronic distribution channels.

They apply to both private customers (B2C) and business customers (B2B), unless otherwise agreed.

By placing an order, the customer agrees to these GTC.

2. Offer and Conclusion of Contract

The products displayed in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.

A purchase contract is concluded once:

  • the order has been completed in the online shop, and
  • Tammaar confirms the order by email.

Tammaar reserves the right to reject orders without providing reasons.

3. Products and Availability

Tammaar sells, in particular:

  • Premium dates in various package sizes
  • Date-based specialty products
  • Gift baskets
  • Vouchers
  • Events and tasting experiences

All products are subject to availability. If a product is not available, the customer will be notified.

Minor variations in colour, shape, weight, or packaging are reserved, particularly for natural products.

4. Prices and Shipping

All prices are quoted in Swiss francs (CHF) including statutory value added tax. Shipping costs are shown separately during the ordering process.

Shipping costs are weight-based and are calculated according to the current tariffs of Swiss Post. Tammaar reserves the right to adjust shipping costs in line with current postal tariffs.

For personal delivery by Tammaar, a distance-based delivery flat rate is charged. This amounts to a minimum of CHF 25.00 per delivery.

Price changes are reserved at all times.

5. Delivery and Transfer of Risk

Delivery is made to the address provided by the customer.

Upon handover of the goods to the transport company, the risk passes to the customer. Delivery deadlines are non-binding unless expressly guaranteed in writing.

6. Payment Terms

The following payment methods are accepted:

  • Credit card
  • Twint
  • PayPal
  • Invoice (where offered)

6.1 B2C

Invoices are due immediately.

6.2 B2B

For business customers, a payment term of 14 days net from the invoice date applies.

Upon expiry of the payment deadline, the customer is automatically in default.

Tammaar is entitled to:

  • charge default interest of 5% per annum
  • charge reminder fees

7. Retention of Title

The delivered goods remain the property of Tammaar GmbH until full payment has been received.

8. Withdrawal and Returns

There is no statutory right of withdrawal for perishable foods.

Returns are only possible in the following cases:

  • Incorrect delivery
  • Transport damage
  • Demonstrably defective goods

Complaints must be reported in writing to contact@tammaar.ch within 48 hours of receipt.

9. Warranty

The statutory warranty provisions of the Swiss Code of Obligations apply.

Liability is limited to replacement delivery or refund of the purchase price. Further claims are excluded.

10. Liability

Tammaar is only liable for damages based on intentional or grossly negligent conduct.

Any liability for indirect damages, consequential damages, or lost profits is excluded.

11. Food and Allergy Information

Dates and other products may contain traces of:

  • Nuts
  • Seeds
  • Other allergenic substances

The customer is obliged to check product information before consumption. Tammaar accepts no liability for allergic reactions.

12. Events and Tastings

12.1 Booking

A binding contract is concluded upon booking an event.

12.2 Cancellation – Private Individuals

  • Up to 14 days before the event: free of charge
  • 7 to 14 days before: 50% of the price
  • Less than 7 days before: 100% of the price

12.3 Cancellation – Business Customers

  • Up to 21 days before: free of charge
  • 14 to 21 days before: 50%
  • Less than 14 days before: 100%

Substitute participants are possible at any time.

13. Vouchers

Vouchers can be redeemed in the online shop.

  • No cash payout
  • No interest
  • Validity: 3 years from the date of issue
  • Loss or theft will not be replaced

14. Data Protection

The processing of personal data is carried out in accordance with the applicable privacy policy, available on the websites operated by Tammaar.

15. Applicable Law and Place of Jurisdiction

Swiss law applies exclusively.

The place of jurisdiction is Zug.
