1. Scope
These General Terms and Conditions (the “Terms”) apply to all orders placed with and contracts concluded with Tammaar GmbH (“Tammaar”), irrespective of how the order is placed. They cover in particular orders placed through Tammaar’s online shop and websites, by e-mail, by telephone, through messaging services, at markets and events, and in person.
They apply to private customers and business customers alike, unless otherwise agreed in writing.
By placing an order, the customer accepts these Terms.
2. Offer and conclusion of contract
The products shown do not constitute a legally binding offer but an invitation to place an order.
A contract of sale is concluded once the order has been completed and confirmed by Tammaar. For orders placed at markets and for goods handed over in person, the contract is concluded upon handover.
Tammaar reserves the right to decline orders without giving reasons.
3. Products and availability
Tammaar sells premium dates in various pack sizes, date-based speciality products, gift boxes, vouchers, tastings and events.
All products are subject to availability. If a product is unavailable, the customer will be informed.
Minor variations in colour, shape, weight and packaging are reserved — these are natural products.
4. Prices and delivery charges
All prices are in Swiss francs (CHF) and include value added tax at the statutory rate.
Shipping costs are shown separately during the order process or on the invoice. They depend on weight and follow the tariffs of Swiss Post applicable at the time.
Alongside shipping costs, Tammaar applies two flat rates, depending on the occasion:
- Delivery flat rate — for personal delivery of a goods order by Tammaar. It depends on distance and currently amounts to CHF 25.— per delivery.
- Transport flat rate — for travel to a tasting or event held at the customer’s premises. It currently amounts to CHF 10.— per event.
Both are shown as separate items on the invoice. Prices are subject to change; the amount applicable when the contract is concluded governs.
5. Delivery and passing of risk
Delivery is made to the address given by the customer. Risk passes to the customer when the goods are handed over to the carrier.
Delivery periods are non-binding unless expressly confirmed in writing.
6. Payment terms
6.1 Means of payment
Credit card, TWINT, cash and payment against invoice are accepted, where offered.
6.2 Payment period
Invoices are payable within 10 days of the invoice date, without deduction. This period applies to private and business customers alike.
On expiry of that period the customer is in default without a reminder being required (art. 102 para. 2 of the Swiss Code of Obligations, CO). From that point Tammaar is entitled to charge default interest of 5 % per annum (art. 104 para. 1 CO).
6.3 Reminders
Tammaar sends reminders on the following schedule, counted from the invoice date:

A reminder fee of CHF 20.— is charged from the second formal reminder onwards. The payment reminder and the first formal reminder are free of charge.
If the second reminder also goes unanswered, Tammaar reserves the right to initiate debt enforcement proceedings under the Federal Act on Debt Enforcement and Bankruptcy (DEBA) and to claim further damages for default (art. 106 CO).
That Tammaar sends its first reminder later than default arises is a concession and not a waiver of rights.
7. Retention of title
Goods delivered remain the property of Tammaar GmbH until paid for in full.
8. Cancellation and returns
There is no statutory right of withdrawal for perishable foodstuffs.
Returns are possible in the event of an incorrect delivery, transport damage or demonstrably defective goods. Complaints must be notified in writing to contact@tammaar.ch within 48 hours of receipt.
9. Warranty
The statutory warranty provisions of the Swiss Code of Obligations apply. Liability is limited to replacement delivery or refund of the purchase price. Further claims are excluded.
10. Liability
Tammaar is liable only for damage caused intentionally or through gross negligence. Any liability for indirect damage, consequential damage or loss of profit is excluded.
11. Food and allergy notice
Dates and other products may contain traces of nuts, seeds and other allergens. Customers are required to read the product information before consumption. Tammaar accepts no liability for allergic reactions.
12. Events and tastings
12.1 Booking
A binding contract is concluded upon booking.
12.2 Cancellation — private customers
Free of charge up to 14 days before the event · 50 % from 7 to 14 days · 100 % less than 7 days before.
12.3 Cancellation — business customers
Free of charge up to 21 days before the event · 50 % from 14 to 21 days · 100 % less than 14 days before.
Substitute participants are accepted at any time.
13. Vouchers
Vouchers can be redeemed in the online shop. No cash payout, no interest. Valid for three years from the date of issue. Loss or theft is not compensated.
14. Data protection
The processing of personal data is governed by the privacy policy applicable at the time, available on Tammaar’s websites.
15. Governing law and place of jurisdiction
Swiss law applies exclusively.
The place of jurisdiction is Thalwil, the registered office of Tammaar GmbH.
Mandatory places of jurisdiction are reserved, in particular those provided for consumers by the Swiss Civil Procedure Code (CPC).
16. Language versions
These Terms exist in German and in English. The German version governs; the English version is provided for ease of understanding.
